Terms of Service

1. Acceptance of Terms

By installing or using the Pick Background Chrome extension ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Pick Background is a browser extension that automatically selects a virtual background on a supported video-meeting provider's pre-meeting screen, based on rules you set against the meeting title. The Service does not host, upload, or modify background images; it only selects from the backgrounds already available in your meeting provider's native picker.

3. Account Registration

To use Pick Background, you must sign in with a Google account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Free and Paid Plans

Pick Background offers both free and paid subscription plans:

• Free Plan: Allows you to create one (1) matching rule and set one (1) default background for a single supported meeting provider.
• Pro Plan: Allows unlimited matching rules and a default background per supported meeting provider.

Subscription fees are billed monthly or annually through Stripe. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period. On cancellation, Pro accounts revert to free-plan limits and only the oldest matching rule is retained.

5. Refund Policy

Due to the nature of digital services, we generally do not offer refunds. However, if you experience technical issues that prevent you from using the Service, please contact us at support@pickbackground.com and we will work with you to resolve the issue or provide a refund at our discretion.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to circumvent any security measures or access controls
• Reverse engineer, decompile, or disassemble the Service
• Share your account credentials with others or allow multiple people to use a single account
• Use the Service to harm, harass, or infringe on the rights of others

7. Third-Party Services

Pick Background interacts with third-party video-meeting providers (such as Google Meet) by reading meeting titles and clicking background tiles in their native pickers. We are not affiliated with, endorsed by, or sponsored by Google or any other meeting provider. Your use of those services remains subject to their respective terms of service.

We cannot guarantee that the Service will always work correctly, as meeting providers may change their interfaces at any time in ways that affect compatibility.

8. Intellectual Property

The Pick Background Service, including its code, design, logos, and content, is owned by Pick Background and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee that the Service will work with all versions of supported meeting providers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICK BACKGROUND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Pick Background and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by uninstalling the extension and contacting us to request account deletion.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on our website or within the extension. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
